Our total liability for any claim shall not exceed the amount you paid for the services giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain implied warranties or limitations of liability.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI), rather than in courts of general jurisdiction.

Arbitration will take place in Davao City, Philippines. The arbitrator's award shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

You and BuildCity agree that each may bring claims only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in Davao City, Philippines.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

If you do not agree to the new Terms, you must stop using the Service.
